Terms of Service

1. Agreement to these Terms
By accessing or using the Service—including browsing, creating an account, verifying age, posting or viewing content, following users, messaging, subscribing, unlocking content, tipping, purchasing promotions, reporting or blocking users, or connecting payment methods—you agree to be bound by these Terms of Service (the "Terms"), our Privacy Policy, our Content Removal / Takedown & Appeals Policy, and any additional policies we publish (including community guidelines and the Content Provider Agreement / Creator Agreement when you use creator features).
If you do not agree, do not use the Service.
If you accept on behalf of an entity, you represent that you have authority to bind that entity.
2. The Service (what Papa's Package is)
Papa's Package is an online platform that enables adults to:
- Create profiles and publish images, video, and other media
- Follow creators, view feeds, like and comment
- Subscribe to creators, unlock pay-per-view (PPV) posts, send tips, and exchange direct messages (including optional paid media)
- Purchase promotional placements (e.g., post boosts and profile spotlights)
- Report content or users and block other accounts
Features may change, break, or be limited during development or maintenance. We may offer free and paid features. We do not guarantee uninterrupted availability, specific ranking, or commercial results from promotions or posts.
3. Eligibility; age; adult content
3.1 Minimum age
You must be at least **eighteen (18) years old**, or the age of majority in your place of residence if higher, to access or use the Service. The Service may include sexually explicit adult content.
3.2 Representations
You represent and warrant that:
- You are 18+ (or the higher age of majority where you live)
- You have legal capacity to enter a binding contract
- Accessing adult content is lawful where you are located
- You will not allow minors to access your account or devices used for the Service
3.3 Age verification
We may use self-attestation, cookies, identity checks, third-party verification, or other measures. We may refuse, suspend, or terminate access if we reasonably believe you are underage or that your age cannot be verified. Failure or refusal to complete required verification may result in denial of Service.
3.4 Adult content warning
By entering, you acknowledge that you may be exposed to adult sexual content, nudity, and other mature themes. You access such content voluntarily.
4. Accounts and security
4.1 Registration
You must provide accurate account information (such as email and username) and keep it updated. You may not sell, rent, or transfer your account without our written permission.
4.2 Credentials
You are responsible for safeguarding passwords and for all activity under your account. Notify us promptly of unauthorized use. We are not liable for losses caused by unauthorized use resulting from your failure to secure credentials.
4.3 One person, one primary identity
You may not create accounts primarily to evade bans, blocks, enforcement actions, or payment obligations, or to harass others.
4.4 Suspension and termination
We may suspend, limit, or terminate accounts or features at any time for violation of these Terms, legal risk, fraud, chargebacks, safety concerns, non-payment, or operational reasons. You may stop using the Service at any time. Provisions that by nature should survive (including licenses granted to us for the period content remains hosted, payment obligations, indemnities, and limitations of liability) survive termination.
5. User content; license; responsibility
5.1 Your content
"User Content" means text, images, video, audio, profiles, messages, comments, metadata, and any other material you submit or make available through the Service.
You retain ownership of your User Content, subject to the licenses below and third-party rights.
5.2 License you grant us
You grant Papa's Package a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (for formatting/transcoding/thumbnails), display, perform, distribute, and otherwise use your User Content as reasonably necessary to operate, improve, promote, and secure the Service—including feeds, search, profiles, messaging, paid access, and paid promotions you purchase.
This license continues for as long as your content is stored on the Service and for a reasonable period afterward for backups, legal compliance, and dispute handling.
5.3 Your warranties about content
You represent and warrant that:
- You own or control all rights needed to post the content and grant the licenses above
- Content does not infringe IP, privacy, publicity, or other rights of any person
- All persons depicted are 18+ and have provided all required consents (including for commercial adult distribution where applicable)
- Content is not illegal and does not violate Section 6 (Prohibited Conduct)
5.4 No endorsement
User Content is the responsibility of the users who post it. We do not endorse User Content and are not obligated to monitor all content, though we may review, remove, restrict, or refuse content at our discretion.
5.5 Backup
You are responsible for maintaining your own copies of content you care about. We are not a backup service.
6. Acceptable Use Policy — Prohibited Content
This Section 6 is the binding Acceptable Use / Prohibited Content policy for the Service. It applies to all User Content and to all use of the Service (including posts, messages, profiles, live or recorded media, captions, comments, promotions, and external links you distribute via the Service).
6.1 Permitted content (affirmative scope)
Subject to this Section 6 and applicable law, Papa's Package permits **consensual adult sexual and non-sexual content** created by and featuring only individuals who are **eighteen (18) years of age or older**, where each identifiable person has provided any consent and documentation required by these Terms, the Content Provider Agreement, and United States law.
Without limiting the foregoing, **consensual adult kink, fetish, niche, and role-play content between verified adults is allowed**, including fictional or role-play scenarios that do not depict actual minors, actual non-consensual sexual violence, actual illegal acts, or other categories prohibited below. Papa's Package is intentionally more permissive on **consensual adult** niche and kink content than many competing adult platforms, while remaining **strictly prohibitive** of the legal and high-liability categories listed in this Section.
"Allowed" does not mean we must host any particular item. We may remove or restrict content that violates these Terms, processor rules, or law, or that we reasonably determine creates material litigation, safety, or compliance risk under the categories below.
6.2 Absolute prohibitions
You may not upload, post, stream, message, solicit, link to, advertise, monetize, or otherwise distribute through the Service any content that falls into the following categories. These prohibitions are **strict**. Attempted circumvention (including coded language, metadata, partial cropping, or "jokes") is treated as a violation.
#### 6.2.1 Minors and Child Sexual Abuse Material (CSAM) — zero tolerance
Prohibited without exception:
- Any sexual content—or any content intended for sexual arousal—that depicts, describes, or involves a person under eighteen (18) years of age, whether real or fictional.
- Child Sexual Abuse Material (CSAM) as defined under United States federal law, including production, possession, distribution, solicitation, or advertising of such material via the Service.
- Any suggestion, implication, role-play, costume, caption, hashtag, filename, thumbnail, or narrative that presents a person as under eighteen (18) in a sexual context.
- Any AI-generated, illustrated, animated, or synthetic depiction of sexual content involving a minor (under 18), or a character that is described or presented as under 18.
- Grooming, solicitation, or sexual communication directed at a minor, or content that facilitates contact between adults and minors for sexual purposes.
We maintain **zero tolerance** for this category. Violations result in immediate content removal and account termination, and we may preserve and disclose data to law enforcement as required or permitted by law.
#### 6.2.2 Non-consensual intimate imagery (NCII)
Prohibited:
- Distribution of intimate images or video of a real person without that person's affirmative consent to the distribution (including so-called "revenge porn").
- Non-consensual recording or distribution of intimate or sexual content obtained by hidden camera, spy-cam, bathroom/changing-room recording, upskirt or similar covert methods, or any recording made without the subject's knowledge and consent where consent was legally required.
- Non-consensual deepfakes, face swaps, or other synthetic intimate or sexual media of a **real, identifiable person** created or distributed without that person's affirmative consent.
- Threats to create, disclose, or distribute intimate imagery of a person (including sextortion).
#### 6.2.3 Non-consensual sexual acts
Prohibited:
- Content that depicts **actual** rape, sexual assault, or sexual activity obtained through coercion, incapacitation, or force without affirmative consent.
- Content that **clearly simulates** rape, sexual assault, or non-consensual sexual acts in a manner that presents the absence of affirmative consent as real or authentic, rather than as disclosed, consensual adult role-play between verified adults.
**Clarification:** Consensual adult role-play between verified 18+ participants, with clear affirmative consent of all persons depicted, is not prohibited solely because it uses fictional "non-consent" themes, provided it does not violate Sections 6.2.1, 6.2.2, or other subsections of this Section 6.
#### 6.2.4 Bestiality and sexual content involving animals
Prohibited: any sexual content depicting sexual acts with animals, or sexual contact between a human and an animal, whether real or simulated.
#### 6.2.5 Real incest
Prohibited: sexual content involving actual biological or legal family members who are related as such in real life.
**Clarification:** Role-play between **consenting adults who are not actual family members** (including "step" or fictional family scenarios performed by unrelated adults) is **not** prohibited under this subsection, provided all other rules in this Section 6 are met.
#### 6.2.6 Real illegal violence, death, torture, and extreme injury for sexual purposes
Prohibited:
- Content that depicts or promotes **real** illegal activity as defined under United States federal or applicable state law when presented for sexual purposes or as sexual entertainment.
- Content depicting **real** death, murder, or snuff.
- Content depicting **real** torture or **real** extreme physical injury inflicted on a person for sexual purposes.
This subsection addresses **real** acts and real harm. It does not ban fictional adult media or consensual adult role-play that does not depict actual death, actual torture, or actual extreme injury of a real person.
#### 6.2.7 Copyright infringement, doxxing, and other clear U.S. legal violations
Prohibited:
- Content that infringes copyright, trademark, or other intellectual property rights of another person or entity (including distribution of stolen or pirated creator content).
- Doxxing: publishing another person's private personal information (such as home address, private phone number, government ID numbers, or private financial account data) without lawful authority or consent, for the purpose of harassment, intimidation, or unwanted contact.
- Fraud, scams, phishing, malware distribution, human trafficking or trafficking in persons, and other conduct that clearly violates United States federal law or applicable state law when carried out through the Service. See also Section 17 (Anti-Human Trafficking Policy).
6.3 Operational safeguards (platform and creator obligations)
The following safeguards apply to use of the Service. Creators and other users must cooperate fully.
- **Creator age verification.** Every creator account must complete government-issued photo identification age verification establishing that the account holder is eighteen (18) years of age or older before monetizing or, where we so require, before publishing adult content. Fans may be subject to age gates and additional verification as we implement.
- **Multi-person content; consent and releases.** For any content depicting more than one identifiable person, the uploading creator must possess and retain written consent and model/performer releases from each identifiable adult depicted, authorizing creation and distribution on the Service. We may require upload of releases or other records before or after publication and may remove content if records are missing, incomplete, or unreliable.
- **Hash matching and automated detection.** We may use hash matching and similar technologies against known CSAM databases and, where available, known non-consensual intimate imagery (NCII) datasets, and may use other automated or manual review tools. Detection is not guaranteed to find all prohibited content; you remain responsible for what you upload.
- **Rapid takedown of NCII.** Upon receiving a valid report of non-consensual intimate imagery, or upon our independent determination that content is NCII, we will act expeditiously to remove or disable access to the material and may suspend or terminate accounts involved. Repeat or egregious NCII violations result in permanent termination.
- **Reporting.** Users must use in-product reporting tools (or designated legal/safety contacts we publish) to report CSAM, NCII, or other prohibited content. Knowingly filing false reports may result in enforcement action.
Failure to comply with required verification, consent/release, or record-keeping obligations is an independent violation of these Terms and may result in content removal and account termination even without a separate content category finding.
6.4 Related prohibited conduct (platform integrity)
In addition to content categories above, you may not:
- Circumvent age gates, paywalls, blocks, bans, or access controls.
- Impersonate another person or entity in a misleading manner.
- Scrape, bulk-download, or use automated means to access the Service in a manner that harms operations or violates these Terms.
- Manipulate promotions, rankings, likes, follows, or engagement through fraud or deception.
- Send unsolicited spam messages or operate deceptive commercial schemes via the Service.
6.5 Enforcement and consequences
- **Immediate removal.** Content that violates this Section 6 may be removed or disabled immediately, without prior notice.
- **Account termination.** Violations—especially of Sections 6.2.1 (minors/CSAM), 6.2.2 (NCII), 6.2.3 (non-consensual sexual acts), 6.2.4 (bestiality), 6.2.5 (real incest), or 6.2.6 (real death/torture/extreme injury)—will result in **immediate account termination** and may include permanent bans on related accounts and payment identities.
- **Other remedies.** We may limit features, withhold or reverse promotions or payouts where permitted by law and processor rules, preserve evidence, and report to and cooperate with law enforcement, payment processors, and rights holders.
- **No waiver.** Failure to enforce any provision in a particular instance is not a waiver of our right to enforce it later.
- **Appeals.** Where we offer an appeal or review process in-product or by published contact, you may use that process. Appeals do not require us to reinstate content or accounts that we reasonably determine violate this Section 6 or law.
6.6 Interpretation
If any provision of this Section 6 conflicts with a more specific Content Provider Agreement term on performer records, the provision that is **more protective of legal compliance and consent** controls for that subject. Capitalized terms not defined in this Section have the meanings given elsewhere in these Terms.
7. Interactions between users; blocks; reports
7.1 User interactions
You are solely responsible for your interactions with other users. Exercise caution. We do not conduct criminal background checks on all users.
7.2 Blocking
You may block other users. Blocking is intended to reduce visibility and contact between accounts as implemented in the product (for example, feeds and messaging). Blocking is not a guarantee of total non-contact across all surfaces or offline channels.
7.3 Reporting
You may report content or users. We may investigate and act at our sole discretion. We are not obligated to take any particular action or to inform you of outcomes, except where required by law.
7.4 Safety tools are not law enforcement
Reports and blocks do not replace contacting local authorities when you are in danger or a crime has occurred.
8. Payments, subscriptions, unlocks, tips, and refunds
8.1 Payment processors
Paid features are currently processed by **CCBill**. We may designate additional or successor adult-friendly processors (including **Epoch** as a configured backup). Your use of payment methods is also subject to the processor's terms and policies. We do not store full payment card numbers; card data is handled by the processor.
8.2 Prices and taxes
Prices are shown at the point of purchase and may change prospectively. You are responsible for applicable taxes unless we state that tax is collected at checkout.
8.3 Subscriptions and cancellation
Subscriptions renew according to the plan selected until canceled. You authorize recurring charges for each renewal period until you cancel.
**Cancellation:** To cancel a subscription and stop further billing, use the cancellation option in your account settings (Subscriptions) when available, or contact **CCBill Consumer Support** at https://support.ccbill.com/ or **888.596.9279** (or the support channel for any other processor we designate). **Cancellations are possible at any time.** Cancel before the renewal date to avoid the next period's charge where the processor so requires. Cancellation stops future renewals; access may continue through the end of the period already paid, subject to processor and product rules.
8.4 PPV, tips, paid messages, and refunds
One-time unlocks, tips, and paid message media are delivered digitally upon successful payment. **Refund and billing adjustment requests are handled case-by-case** by the payment processor’s consumer support (for CCBill: https://support.ccbill.com/ or 888.596.9279) and/or by us where we can assist. We do **not** state that transactions are non-refundable or that refunds must be requested within a fixed short window that restricts processor consumer-support rights. Mandatory consumer-protection law, if applicable to you, is not limited by these Terms.
8.5 Promotions (boosts and spotlights)
Promotional products are **prepaid advertising / placement products**. They do **not** guarantee impressions, clicks, followers, revenue, or any particular commercial outcome. Duration and ranking weight are as described at purchase. We may pause or remove promotions that violate these Terms without obligation to extend time if removal is for cause.
8.6 Chargebacks and payment disputes
Unfounded chargebacks or payment disputes may result in suspension, collection activity, and reporting to processors. Contact us before filing a dispute when possible.
8.7 Creator earnings
If creator payouts are enabled, payout timing, holds, fees, and eligibility are governed by processor rules, our Content Provider Agreement, and any payout schedule we publish. We may withhold or reverse amounts related to fraud, chargebacks, or policy violations.
8.8 Currency and crypto
Unless we explicitly enable additional methods, payments are processed in card and other methods supported by our adult payment processor(s). Cryptocurrency options, if enabled later, will be subject to processor availability and additional terms.
9. Intellectual property of the platform; DMCA
9.1 Our IP
The Service's branding, software, design, and documentation are owned by us or our licensors. You may not copy or exploit them except as allowed by these Terms.
9.2 Copyright complaints (DMCA-style notice)
If you believe content on the Service infringes your copyright, send a notice including:
- Your contact information
- Identification of the work claimed infringed
- Identification of the material and its location on the Service
- A statement of good-faith belief that use is not authorized
- A statement under penalty of perjury that the information is accurate and that you are the owner or authorized agent
- Your physical or electronic signature
Send notices to the contact method published on the Service (see also our standalone **Content Removal / Takedown & Appeals Policy** at /legal/content-removal). We may remove content and terminate repeat infringers in appropriate circumstances.
**Counter-notice:** If your content was removed and you believe it was a mistake, you may submit a counter-notice with the information required under applicable law. Appeals and general content-removal requests (including non-copyright complaints) are described in the Content Removal / Takedown & Appeals Policy.
10. Third-party services
The Service uses third-party providers to operate, including hosting (Vercel), database and authentication (Supabase), object storage (Supabase Storage and/or Cloudflare R2), transactional email (Amazon SES), error monitoring (Sentry), optional product analytics, CSAM hash matching (Microsoft PhotoDNA), inbound payments (CCBill; Epoch if we enable that backup rail), and creator payouts (Paxum and other rails a creator selects). Those services are governed by their own terms and privacy policies. We are not responsible for third-party outages or acts beyond our reasonable control. 11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be secure, error-free, or uninterrupted; that content will be accurate; or that promotions will achieve any result.
Some jurisdictions do not allow certain disclaimers; in those places, disclaimers apply to the fullest extent permitted.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAPA'S PACKAGE AND ITS OPERATORS, AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS; LOST DATA; LOSS OF GOODWILL; OR SERVICE INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
Some jurisdictions do not allow certain limitations; in those places, liability is limited to the maximum extent permitted.
13. Indemnification
You will defend, indemnify, and hold harmless Papa's Package LLC and its members, managers, officers, affiliates, and personnel from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your User Content; (b) your use of the Service; (c) your violation of these Terms or law; (d) your infringement or violation of any person's rights; or (e) disputes between you and another user or a payment processor related to your conduct.
14. Dispute resolution; governing law
14.1 Informal resolution
Before filing a formal claim, you agree to try to resolve the dispute informally by contacting us with a description of the issue and a proposed resolution, and allowing thirty (30) days for a response.
14.2 Governing law
These Terms are governed by the laws of the State of **Delaware**, USA, excluding conflict-of-law rules, unless mandatory consumer protections in your country of residence provide otherwise.
14.3 Venue
Subject to applicable consumer rights, courts located in Delaware shall have exclusive jurisdiction, unless we both agree to arbitration in a separate writing.
14.4 Class action waiver (where permitted)
TO THE EXTENT PERMITTED BY LAW, YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
If this waiver is found unenforceable for a particular claim, that claim must proceed in court and be severed from any remaining claims.
15. Changes to the Service and Terms
We may modify the Service and these Terms. For material changes to the Terms, we will update the version and effective date and may require re-acceptance in the product. Continued use after the effective date constitutes acceptance, except where re-acceptance is required by the product or by law.
16. Miscellaneous
- **Entire agreement.** These Terms, the Privacy Policy, and additional policies referenced here form the entire agreement regarding the Service.
- **Severability.** If a provision is unenforceable, the remainder remains in effect.
- **No waiver.** Failure to enforce a provision is not a waiver.
- **Assignment.** You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- **Force majeure.** We are not liable for delays caused by events beyond reasonable control.
- **Export and sanctions.** You may not use the Service if you are prohibited under applicable sanctions or export laws.
- **Language.** English controls if we provide translations.
17. Anti-Human Trafficking Policy
Papa's Package maintains a **zero-tolerance** policy toward human trafficking, sex trafficking, forced labor, debt bondage, involuntary servitude, and any exploitation of persons through force, fraud, or coercion.
17.1 Prohibited conduct
You may not use the Service to:
- Recruit, harbor, transport, provide, obtain, advertise, or solicit any person for labor or commercial sex acts through force, fraud, or coercion.
- Exploit minors in any way (see also Section 6.2.1 — zero tolerance for CSAM and child exploitation).
- Facilitate, promote, or profit from trafficking or related exploitation.
- Post content that knowingly markets trafficked persons or coerced labor or sexual services.
17.2 Reporting
If you suspect trafficking or related exploitation on or through the Service:
- Use in-product reporting tools when available and mark the report as involving safety / illegal exploitation where the UI allows.
- Email **legal@papaspackage.com** and **hello@papaspackage.com** with the subject line **"Trafficking / Exploitation Report"**, including URLs, usernames, post IDs, and any other details you can safely provide.
- Contact local law enforcement and, where applicable, the U.S. National Human Trafficking Hotline (1-888-373-7888 / https://humantraffickinghotline.org/) or equivalent services in your country.
17.3 Our response and cooperation
We will act expeditiously to investigate credible reports, remove or disable access to violative content and accounts, preserve evidence as required or permitted by law, and **cooperate with law enforcement** and payment processors. We may share account, payment, and content metadata with authorized authorities when legally required or when we reasonably believe sharing is necessary to prevent serious harm.
17.4 No retaliation
Good-faith reports of suspected trafficking or exploitation will not result in retaliation by the platform. Knowingly filing false reports may result in enforcement under these Terms.
17.5 Relationship to other policies
This Section is part of these Terms and applies to all users. It complements Section 6 (Acceptable Use), the Content Provider Agreement, the Content Removal / Takedown & Appeals Policy, and the Age Verification, Consent, Monitoring & Compliance Policy at /legal/compliance (operational detail for age, consent, monitoring, and external hotlines).
