Content Provider Agreement
**Also known as:** Creator Agreement **Legal entity / Operator:** Papa's Package LLC (Dover, Delaware) **Product / brand:** Papa's Package **Version:** 2.1.4 **Effective date:** 2026-10-21
This Content Provider Agreement (the "Agreement") applies when you enable creator mode, publish monetized or non-monetized media, sell subscriptions or unlocks, use paid messaging, feature other consenting adults in media, or purchase promotions. It is a **standalone agreement separate from the Terms of Service**. It supplements the Terms, Privacy Policy, Content Removal / Takedown & Appeals Policy, and the **Adult Content Model Release & 2257 Compliance Agreement** (/legal/model-release).
1. Acceptance
By enabling creator features, completing the creator acceptance checkbox in the product, publishing media, or monetizing on the Service, you agree to this Content Provider Agreement, the Terms of Service, the Privacy Policy, and the Adult Content Model Release & 2257 Compliance Agreement. If you do not agree, do not use creator or content-provider features.
Your acceptance is recorded with the document version, content hash, and timestamp associated with your account.
2. Independent content provider status
You are an independent content provider / creator, not our employee, partner, or agent. You control your content and pricing within platform rules. Nothing in this Agreement creates an employment or joint-venture relationship.
3. Eligibility and age verification (mandatory)
3.1 You must be 18+
You must be at least **eighteen (18) years old**, or the age of majority in your place of residence if higher. You represent and warrant that you meet this requirement when you accept this Agreement and on an ongoing basis.
3.2 Platform age verification
You must complete any government-issued photo identification or third-party age verification process we require before monetizing and, where we so require, before publishing adult content. Refusal or failure to complete verification is grounds for denial or removal of creator privileges.
3.3 Persons depicted
You represent that **every person depicted** in your content (including you) is at least 18 years old and has knowingly consented to creation and commercial distribution of the content, including adult distribution where applicable. You will not upload, stream, or distribute content depicting minors, or content that presents a person as under 18 in a sexual context.
3.4 Acknowledgment checkbox
When enabling creator features in the product, you must affirmatively check a box confirming that you are 18+, that you have read this Agreement, and that you agree to all age verification requirements in this Section 3 and in the Terms. That checkbox is a material condition of access to creator tools.
4. Content standards and performer compliance
4.1 Consent for all persons depicted
For any content depicting more than one identifiable person, you must either: (a) have each additional adult complete the **Adult Content Model Release & 2257 Compliance Agreement** (or an equivalent written release) available at /legal/model-release and as a downloadable form, or (b) retain equivalent written consents authorizing depiction, public distribution, upload/display on the Service, and download where offered, and be able to produce those records on request. We may require upload of releases or other records and may remove content if records are missing, incomplete, or unreliable.
4.2 Records (including U.S. 18 U.S.C. § 2257-type obligations)
Where 18 U.S.C. § 2257 or § 2257A applies to content you produce, you are responsible for creating, maintaining, and producing the required identification and consent records, and for designating a records custodian when the law requires one. Papa's Package LLC holds copies of identity documents and releases you submit, reviews posts before publication, and will produce the copies it holds in response to a lawful request. This agreement does not decide whether the company is a producer or a custodian under those statutes. You agree to provide proof of your own records if we reasonably request it for compliance or an investigation.
We may suspend monetization or remove content if we cannot verify compliance. See also the Model Release & 2257 Compliance Agreement at /legal/model-release.
4.3 Rights clearance
You warrant you own or have licenses to all music, trademarks, locations, and third-party materials included in your content.
4.4 Prohibited creator content
In addition to the Terms (including the Anti-Human Trafficking Policy), you may not monetize or distribute content that is non-consensual, involves minors, is illegal, promotes trafficking or exploitation, or is obtained by deception or coercion.
5. Content ownership and platform license
You retain ownership of your original content, subject to the licenses you grant us. You grant us the licenses in the Terms, including the right to host, store, reproduce (for formatting/transcoding), display, perform, distribute, and deliver content to entitled users, and to display content in feeds and promotional placements you purchase or that are necessary to operate the Service.
6. Pricing, offerings, and fan relationships
You are responsible for:
- Setting tier prices, PPV prices, and paid message prices in compliance with law and platform minimums
- Descriptions of what fans receive (no deceptive claims)
- Customer service for your content, except processor or platform outages
Fans' access rights are governed by the Terms and the purchase terms at checkout. You will not encourage chargebacks or payment fraud.
7. Payments, fees, and payouts
7.1 Processors
Fan payments are processed by an adult payment processor we designate. Checkout may be unavailable until that connection is live. Creator payouts are currently made primarily through Paxum, and may also use other rails you select in Studio (for example Wise, PayPal, or ACH) when those rails are offered. You must provide accurate payout identity information and complete any required KYC/KYB.
7.2 Fees
Creator marketplace fees are disclosed in the product and on the public fees page. The standard model is an **all-in** percentage of gross that includes platform services and payment processing (no separate processor fee charged to creators on marketplace earnings). Published volume discounts and founding preferential rates, if any, are as stated in product documentation. Fees may change prospectively with notice; preferential windows already granted are honored for their stated duration unless the account is terminated for cause.
7.3 Payouts
When creator payouts are enabled, eligible balances are paid under the platform’s standard weekly cycle (typically paid on Friday), subject to minimums, destination setup, tax documentation, identity/KYC gates, processor settlement, and ops review. There is no creator “request payout” form for the standard weekly run; enrollment and readiness requirements apply as shown in Creator Studio.
7.4 Holds, offsets, and clawbacks
We or processors may hold, delay, offset, or reverse amounts for suspected fraud, chargebacks, Terms violations, legal process, or identity verification failures.
7.5 Taxes
You are an independent contractor, not an employee. You are solely responsible for determining and paying taxes on your earnings (income, sales, VAT/GST, and any other taxes) in your jurisdiction. This Agreement does not provide tax, legal, or accounting advice.
Before the first payout is released, you must submit valid tax documentation in Creator Studio:
- **U.S. persons** — a completed Form **W-9**
- **Non-U.S. individuals** — Form **W-8BEN**
- **Non-U.S. entities** — Form **W-8BEN-E**
Where required by law, we may issue information returns such as Form **1099-NEC** to U.S. creators who meet the applicable reporting threshold for the calendar year (including the threshold published in our product documentation, currently **$2,000** under IRS rules referenced for 2026). Non-U.S. creators generally do not receive a 1099. Thresholds and form requirements may change when law or guidance changes.
8. Promotions and advertising products
8.1 Nature of promotions
Post boosts, profile spotlights, and similar products are prepaid advertising/placement products. They provide preferential ranking or placement for a limited time according to the product catalog.
8.2 No performance guarantee
We do not guarantee impressions, reach, engagement, subscribers, revenue, or ROI. Ranking weights and durations are as published at purchase.
8.3 Abuse
You may not use bots, fake accounts, or coordinated inauthentic behavior to amplify promotions. We may cancel promotions for policy violations without refund when cancellation is for cause, subject to mandatory consumer law.
8.4 Catalog changes
We may change promotion prices and offerings prospectively. Existing active promotions continue for their purchased term unless removed for cause or legal reasons.
9. Messaging and paid media
If you send paid message media, you must clearly communicate the nature of the content within platform UI constraints. You remain responsible for the legality and consents related to that media. Fans who unlock content obtain access under the Terms; you will not revoke access in a way that constitutes fraud.
10. Conduct toward fans and other creators
You will not harass, blackmail, defraud, or dox fans or other creators. You will not post another person's private information. You will comply with block and report outcomes implemented by the platform.
11. Creator responsibilities (summary)
You are responsible for: (a) age and identity accuracy; (b) consents and records for all performers; (c) legality of content and marketing claims; (d) taxes on your earnings; (e) compliance with processor and payout-rail rules (including Paxum and any payment processor we designate); and (f) cooperation with lawful investigations and platform compliance requests.
12. Platform rights to remove content and terminate
We may remove or restrict content, disable monetization, withhold or reverse payouts related to violative activity, terminate creator privileges, or ban accounts for violations of this Agreement, the Terms, payment-processor rules, or law. We may preserve data for investigations and legal compliance. Our Content Removal / Takedown & Appeals Policy describes how users and rights holders request removal and how appeals work.
13. Indemnification
You will indemnify and hold us harmless from claims arising out of your content, your failure to maintain required performer records or age verification, your tax obligations, your marketing claims, or your breach of this Agreement—consistent with the indemnification terms in the Terms of Service.
14. Disclaimers and liability
Creator tools are provided "as is." Liability limitations in the Terms apply to this Agreement. We are not liable for fan behavior, processor outages, or promotion underperformance.
15. Changes
We may update this Agreement by publishing a new version. Material changes may require re-acceptance before continued use of creator monetization features.
