Content Removal / Takedown & Appeals Policy

This is a **standalone policy** required for payment-processor and platform compliance. It is not buried solely inside the Terms of Service. It covers how to request content removal, file complaints, and appeal enforcement decisions. It is an operational template—not legal advice.

1. Purpose and scope

This Policy explains how users, creators, depicted persons, rights holders, and the public may:

  1. Request removal or restriction of content on Papa's Package
  2. File complaints about content, accounts, or enforcement actions
  3. Appeal certain decisions

It applies to User Content on https://www.papaspackage.com and related apps we operate (the "Service"), including posts, profiles, messages where we can act, media, captions, and promotions.

3. How to submit a takedown, removal, or complaint

3.1 Preferred channels (use one)

  1. **In-product reporting** — Use Report on the post, profile, or message when available. Include category (e.g., copyright, non-consensual, underage suspicion, harassment, other illegal).
  2. **Email** — Send to **legal@papaspackage.com** and/or **dmca@papaspackage.com** (and **hello@papaspackage.com** if those addresses are not yet active). Use a clear subject line:
  3. **Studio / account tools** — Creators may use Studio tools (where offered) for DMCA counter-notices or ownership disputes involving their own account.

3.2 What to include

To act quickly, include as much as you can:

  • Your name and a working contact email
  • Your relationship to the content (owner, depicted person, authorized agent, etc.)
  • Exact URLs, post IDs, usernames, or screenshots locating the material
  • Description of the issue and the relief you seek (remove post, hide media, terminate account, etc.)
  • For copyright (DMCA-style): the elements listed in the Terms (identification of work, location of material, good-faith statement, accuracy statement under penalty of perjury, signature)
  • For NCII / privacy: confirmation that you are the person depicted or their authorized representative, and that distribution was not consented to

Incomplete requests may delay action. We may ask for additional verification.

3.3 Emergency safety

If you are in immediate danger, contact local emergency services first. Platform reports are not a substitute for law enforcement.

4. Categories we prioritize

We treat the following with highest urgency:

  1. Child sexual abuse material (CSAM) / exploitation of minors — **zero tolerance**
  2. Non-consensual intimate imagery (NCII) and related extortion
  3. Human trafficking / forced exploitation reports
  4. Credible threats of violence
  5. Valid copyright (DMCA-style) notices
  6. Other illegal content under applicable U.S. law
  7. Terms / Acceptable Use violations (harassment, spam, fraud, etc.)

5. Response timelines

We aim to process requests as follows (business days, U.S. Eastern, excluding force majeure):

These are operational targets, not guarantees. Complex or incomplete requests may take longer. We may remove or restrict content pending investigation when risk is high.

6. What we may do

After review we may:

  • Remove, delist, blur, or geo-restrict content
  • Suspend or terminate accounts
  • Preserve logs and media for legal compliance
  • Notify the uploading user (except where notice would create risk or is prohibited)
  • Report to and cooperate with law enforcement and payment processors
  • Decline action when the request is incomplete, not credible, or outside our control

7. Appeals

7.1 Who may appeal

You may appeal if:

  • Your content or account was removed or restricted and you believe the decision was mistaken or based on incomplete information
  • Your removal request was denied and you have new material evidence

7.2 How to appeal

Email **legal@papaspackage.com** with subject **"Appeal"** within **30 days** of the decision you contest. Include:

  • Your username and contact email
  • Reference to the original report or decision (ticket ID, post URL, date)
  • Why you believe the decision should change
  • Any new evidence

7.3 Appeal review

We aim to acknowledge appeals within **5 business days** and complete review within **15 business days** where practicable. One good-faith appeal per decision is generally available; repeated frivolous appeals may be disregarded. Appeals do **not** require us to reinstate content or accounts that we reasonably determine violate the Terms, law, or processor rules.

7.4 Counter-notice (copyright)

If content was removed under a copyright notice and you believe it was a mistake or misidentification, you may submit a counter-notice with the information required under applicable law (including 17 U.S.C. § 512 where U.S. law applies). We may forward the counter-notice to the complainant and restore content when legally appropriate.

8. False or abusive reports

Knowingly filing false, harassing, or bad-faith reports may result in account enforcement, including suspension or termination.

9. Creators and depicted persons

Creators must honor lawful removal obligations and the Content Provider Agreement. Persons depicted without required consent should use Section 3 (NCII / privacy) channels. Creators who repeatedly post violative content may lose monetization and account access.

10. Relationship to Terms

This Policy is incorporated by reference into the Terms of Service. If there is a conflict on procedure for notices and appeals, this Policy controls for removal/appeals procedure; the Terms control for substantive prohibited-content rules and liability.

11. Changes

We may update this Policy by publishing a new version and effective date on this page. Material changes may also be noted in-product.
