Creator Agreement

This Creator Agreement applies when you enable creator mode, publish monetized content, sell subscriptions or unlocks, use paid messaging, or purchase promotions. It supplements the Terms of Service and Privacy Policy. Not legal advice—have counsel review, especially regarding adult record-keeping and tax obligations in your jurisdiction.

1. Acceptance

By enabling creator features or monetizing on the Service, you agree to this Creator Agreement ("Agreement"), the Terms, and the Privacy Policy. If you do not agree, do not use creator monetization features.

2. Independent creator status

You are an independent creator, not our employee, partner, or agent. You control your content and pricing within platform rules. Nothing in this Agreement creates an employment or joint-venture relationship.

3. Eligibility

You must meet all eligibility requirements in the Terms (including 18+ / age of majority). You must have legal capacity to enter commercial contracts and to grant the licenses in the Terms and this Agreement.

4. Content standards and performer compliance

4.1 Age and consent

You represent that every person depicted in your content is at least 18 years old and has knowingly consented to creation and commercial distribution of the content, including adult distribution where applicable.

4.2 Records (including U.S. 18 U.S.C. § 2257-type obligations)

Where required by law (including U.S. federal record-keeping obligations for producers of actual sexually explicit content), you are solely responsible for creating, maintaining, and producing upon lawful request all required identification and consent records for performers. You agree to designate a records custodian as required and to provide proof of compliance if we reasonably request it for compliance or investigation.

We may suspend monetization or remove content if we cannot verify compliance.

4.3 Rights clearance

You warrant you own or have licenses to all music, trademarks, locations, and third-party materials included in your content.

4.4 Prohibited creator content

In addition to the Terms, you may not monetize content that is non-consensual, involves minors, is illegal, or is obtained by deception or coercion.

5. Platform license for monetization and promotions

You grant us the licenses in the Terms, including the right to host and deliver paid content to entitled users and to display content in feeds and promotional placements you purchase or that are necessary to operate paid features.

6. Pricing, offerings, and fan relationships

You are responsible for:

• Setting tier prices, PPV prices, and paid message prices in compliance with law and platform minimums
• Descriptions of what fans receive (no deceptive claims)
• Customer service for your content, except processor or platform outages

Fans' access rights are governed by the Terms and the purchase terms at checkout. You will not encourage chargebacks or payment fraud.

7. Payments, fees, and payouts

7.1 Processors

Payments may be processed by CCBill, Epoch, or other designated processors. You must provide accurate payout identity information if payouts are enabled and complete any required KYC/KYB.

7.2 Fees

Platform and processor fees (if any) will be disclosed in the product or payout documentation. Fees may change prospectively with notice.

7.3 Holds, offsets, and clawbacks

We or processors may hold, delay, offset, or reverse amounts for suspected fraud, chargebacks, Terms violations, legal process, or identity verification failures.

7.4 Taxes

You are solely responsible for determining and paying taxes on your earnings (income, sales, VAT/GST, etc.). We may issue tax forms where required if we have your tax information.

8. Promotions and advertising products

8.1 Nature of promotions

Post boosts, profile spotlights, and similar products are prepaid advertising/placement products. They provide preferential ranking or placement for a limited time according to the product catalog.

8.2 No performance guarantee

We do not guarantee impressions, reach, engagement, subscribers, revenue, or ROI. Ranking weights and durations are as published at purchase.

8.3 Abuse

You may not use bots, fake accounts, or coordinated inauthentic behavior to amplify promotions. We may cancel promotions for policy violations without refund when cancellation is for cause, subject to mandatory consumer law.

8.4 Catalog changes

We may change promotion prices and offerings prospectively. Existing active promotions continue for their purchased term unless removed for cause or legal reasons.

9. Messaging and paid media

If you send paid message media, you must clearly communicate the nature of the content within platform UI constraints. You remain responsible for the legality and consents related to that media. Fans who unlock content obtain access under the Terms; you will not revoke access in a way that constitutes fraud.

10. Conduct toward fans and other creators

You will not harass, blackmail, defraud, or dox fans or other creators. You will not post another person's private information. You will comply with block and report outcomes implemented by the platform.

11. Enforcement

We may remove content, disable monetization, withhold payouts related to violative activity, terminate creator privileges, or ban accounts for violations of this Agreement or the Terms. We may preserve data for investigations and legal compliance.

12. Indemnification

You will indemnify and hold us harmless from claims arising out of your content, your failure to maintain required performer records, your tax obligations, your marketing claims, or your breach of this Agreement—consistent with the indemnification terms in the Terms of Service.

13. Disclaimers and liability

Creator tools are provided "as is." Liability limitations in the Terms apply to this Agreement. We are not liable for fan behavior, processor outages, or promotion underperformance.

14. Changes

We may update this Agreement by publishing a new version. Material changes may require re-acceptance before continued use of creator monetization features.
